Our expert adviser and witness services focus on pensions litigation cases involving mainly DB pension schemes together with actuarial disciplinary cases. We have been involved in a number of cases since 2009 including Court experience in the high profile Nortel case.

Our team of Mark Stocker and Mike Hammer have over 60 years of experience between them including over 20 years each as Scheme Actuaries.

They have worked for some of the leading actuarial firms including Mercer, Aon and LCP. Their last roles were at Buck Consultants where Mark was Head of Wealth responsible for the retirement and investment practices as well as a UK director and Chief Actuary and Mike was a senior consulting actuary.

Mark and Mike have worked together over the last 30 years and since 2013 when Mike joined Mark at Buck they have built up a well-regarded expert witness practice.

Examples of our cases

Acted for a US reinsurer in a professional negligence case where an actuarial firm was alleged to have undervalued the liabilities. This involved forensic analysis of a number of valuations and interviewing the key personnel. A detailed report was produced. The case settled out of court.

Acted in the UK pension aspect of Nortel, a major complex and contentious international insolvency. Mark gave evidence in the Ontario Superior Court in a 3 week trial. The judge preferred Mark’s opinion on the actuarial matters at the heart of the case.

Acted for a class action group versus a large UK employer where we determined the quantum of loss suffered on switching from DB to DC. The case went to 2 days of mediation where Mark and Mike were fully involved and an agreement was reached.

Acted for a large consulting firm where it was alleged the documentation was not amended correctly in relation to pension increases. Our report identified the quantum of loss under various scenarios. The case settled.
